Acceptance of these terms

By accessing or using octolytics.com (this "Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site.

What this Site is

This Site is the marketing and informational website for OCTOCX, a device-layer observability and action platform for mobile operators, operated by Octolytics Inc. ("Octolytics," "we," "us"). Use of the actual OCTOCX platform by an operator customer is governed separately by that customer's signed enterprise agreement with Octolytics, not by these Terms.

Using the Site

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use of the Site by, anyone else. You agree not to:

  • Attempt to gain unauthorized access to any part of the Site or its underlying systems.
  • Use automated means (scraping, bots) to extract content at a rate inconsistent with normal human browsing, except as permitted by our robots.txt.
  • Submit false, misleading, or fraudulent information through the demo request or careers forms.
  • Upload malicious files through the careers application flow.
  • Use any content from this Site for data mining, text and data mining, or for training, fine-tuning, or developing any artificial intelligence or machine learning model, whether directly or through a third party.

Intellectual property

The Site's content, including text, graphics, logos, the OCTOCX, SDKCX, DEVICECX, REMOTECX, and LENSCX names and marks, and the overall look and feel, is owned by Octolytics or its licensors and is protected by applicable intellectual property laws. You may view and print pages of the Site for your own personal, non-commercial use, but may not otherwise copy, reproduce, republish, or distribute Site content without our prior written consent.

OCTOCX, SDKCX, DEVICECX, REMOTECX, and LENSCX are trademarks or trade names of Octolytics Inc.

Forms and submissions

Information you submit through the demo request form or careers application flow is handled as described in our Privacy Policy. By submitting a form, you confirm the information you provide is accurate.

No warranty

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by applicable law, Octolytics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site.

The Site may link to third-party websites we do not control. We are not responsible for the content or practices of any linked third-party site.

Governing law

These Terms are governed by the laws of Mexico, without regard to its conflict-of-laws principles, unless a signed enterprise agreement between Octolytics and a customer specifies otherwise for that relationship.

Changes to these terms

We may revise these Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued use of the Site after a change constitutes acceptance of the revised Terms.
